California Assembly Bill 5 (AB5) extends employee classification status to some gig workers. Under AB5, companies must use a three-pronged test to prove workers are independent contractors, not employees.
AB5 was designed to regulate companies that hire gig workers in large numbers, such as Uber, Lyft, and DoorDash.

An individual performing any service shall be considered an employee and not an independent contractor, unless—
This means that a worker providing services is deemed an employee (and not an independent contractor) if they don’t meet all three of the ABC prongs.
Conversely, if they do meet all three prongs, they are deemed an independent contractor, not an employee.
Any technician working on a live event set in the State of California is required to be classified as a W-2 employee.
Certified AV has created a unique employee designation to enable you to be classified as an employee while still pursuing other opportunities independently.
